This document has three parts.

  • Part A is for Customers: the rules you accept when you turn on Texting, and what we submit on your behalf to register your messaging program.
  • Part B is for your Contacts: the messaging terms every business on the Service must publish, with the templates you may copy.
  • Part C is the exact program description, sample messages, and consent flow text that we submit to The Campaign Registry and our carrier for each Customer's campaign.

Capitalized terms have the meanings given in the Terms of Service. Part A is part of the Terms of Service. The Acceptable Use Policy applies to all messaging.

Part A: Customer messaging terms

A1. What Texting is

Texting sends and receives SMS and MMS messages with your Contacts using a phone number provisioned through our carrier account (or your own carrier account if you connect one). It includes the conversational SMS brain, Playbook steps that send texts (missed-call text back, speed to lead, appointment confirmations and reminders, review requests, invoice reminders), Automation "Send SMS" nodes, manual replies from the Inbox, and the AI Receptionist's "send a text" tool.

A2. Registration before sending (10DLC)

United States wireless carriers require every business that sends application-to-person text messages from a standard 10-digit long code to be registered as a brand with an approved campaign in The Campaign Registry ("TCR"). The Service performs this registration for you as the independent software vendor ("ISV") and campaign service provider, under our carrier account, using a separate brand, campaign and dedicated number for each independent Customer business. Unrelated businesses are not pooled under our agency campaign.

You agree that:

  1. You authorize us to submit your legal business information to TCR and our carrier and to act for you in the registration process, including responding to vetting questions and resubmitting corrected information.
  2. The information you give is accurate. Legal business name exactly as registered with your state, business address, EIN (or other tax id), website, business type, industry, and an authorized contact's name, email, and phone. Mismatches between your legal name and your EIN cause rejection, and rejection fees are non-refundable.
  3. You will use the number only for the registered use case described in Part C, and you will tell us before changing the purpose, volume, or content of your messaging so we can update the campaign.
  4. Texting goes live only after approval. Outbound texting stays disabled until the carrier has fully provisioned the campaign and verified its dedicated business-number assignment. You can see progress in Receptionist settings. Calling and inbound messaging depend on number provisioning and service activation; no immediate availability or approval time is guaranteed.
  5. Fees. Carrier brand registration, campaign vetting, and monthly campaign fees are passed through at actual carrier cost, separately from our one-time $25 USD initial application submission service fee shown before payment. Corrections and interrupted requests do not collect another $25 service fee. They are non-refundable once incurred by the carrier. SMS usage in either direction is actual Telnyx cost plus thirty percent, with fractional-credit rounding carried forward under the Terms of Service.
  6. Throughput. Carriers assign a daily message cap and a per-second rate to each campaign based on the brand's trust score. The Service enforces these caps. You may not split traffic across multiple numbers or Organizations to evade them ("snowshoeing").

Before the Service sends a text to a Contact on your behalf, you must have the consent that the message type requires, recorded in the Contact's consent ledger:

Message typeConsent requiredExamples
ConversationalImplied consent from the Contact texting you first, for that conversationA Contact texts your number; the SMS brain replies
InformationalPrior express consent: the Contact gave you their number for this purposeAppointment confirmations and reminders, booking links they asked for, order and job status, receipts, missed-call text back after they called you
PromotionalPrior express written consent: a clear, signed or checked opt-in that names your business, says they will receive marketing texts, and includes the required disclosuresOffers, promotions, review requests with an incentive, re-engagement campaigns, any text to a lead who did not ask to be texted

"Written" consent includes a checkbox on a web form, a keyword the Contact texts to your number, a signed paper form, or a recorded verbal consent that includes the disclosures. A prechecked box, a purchased list, a scraped number, a lead-finder result, or a number given for a different purpose is not consent.

Every opt-in must be recorded with: the phone number, the date and time, the source (form URL, keyword, paper form, call recording), the exact consent language shown, and the IP address where available. The Service records this automatically for its own forms and keywords; import records for any other source.

A4. Required content in your messages

  • Identification. The first message in any new conversation and every promotional message must include your business name.
  • Opt-out instructions. The first message to a Contact, every promotional message, and at least one message per month in any ongoing program must include "Reply STOP to opt out" or equivalent. The Service appends this footer to Playbook and Automation texts by default; if you remove it in a template, compliance is yours.
  • Help. The Service answers HELP automatically with your business name, a support contact, and opt-out instructions.
  • Links. Use full branded links or the Service's link domain. Public URL shorteners (bit.ly, tinyurl, and similar) are blocked by carriers.
  • No prohibited content. See Section 5 of the Acceptable Use Policy for the prohibited and restricted categories (SHAFT and high-risk financial content among them).

A5. Opt-out handling

The Service processes STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT immediately by marking the Contact opted out on that number, sending one confirmation message, and blocking every further outbound text to that Contact from that Organization. START, UNSTOP, and YES re-enable messaging. You must not text an opted-out Contact from another number or Organization, must not ask them to opt back in by text, and must treat an opt-out expressed in any other words (for example "please stop texting me") the same way, by marking the Contact opted out in the Inbox.

A6. Timing and frequency

Promotional texts may be sent only between 8:00 a.m. and 9:00 p.m. in the Contact's local time (determined by area code or the Contact's address), or the narrower window a state requires. The Service's quiet-hours setting enforces this for Playbooks and Automations. Send only the frequency you disclosed at opt-in. Carriers treat more than about 4 promotional texts per month to the same person, or more than 1 per day, as a spam signal.

A7. Publishing your messaging terms and privacy policy

Carriers and TCR require that a Contact who opts in can find your messaging terms and your privacy policy. You must:

  1. Publish a privacy policy for your business that states that mobile information and opt-in consent will not be shared with or sold to third parties for their marketing purposes, and that text-messaging originator opt-in data and consent will not be shared with any third parties. Tenant Sites generated by the Service include a privacy page with this language; if you use your own website, add it.
  2. Publish messaging terms using the template in Part B, on your Tenant Site or your own website, at a URL you enter in Receptionist settings.
  3. Show, at every opt-in point, the consent disclosure in Part B, including the "message and data rates may apply" and frequency statements, and link to both pages.

The Service adds the messaging-terms and privacy links to its hosted forms automatically.

A8. Your responsibility

You are the sender of every text. You are responsible for consent, content, timing, frequency, and opt-out handling, and for complaints, carrier fines, and claims that arise from your messaging, as the Terms of Service provide. We may pause Texting immediately if your opt-out rate, complaint rate, or carrier filtering rate rises above carrier thresholds, or if the carrier or TCR requires it.

Publish the following on your website (edit the bracketed fields; do not remove the required statements).

B1. Messaging terms template (publish at your "SMS terms" page)

[BUSINESS LEGAL NAME] Text Messaging Terms

By opting in to text messages from [BUSINESS LEGAL NAME] ("[BUSINESS SHORT NAME]", "we"), you agree to receive text messages at the mobile number you provided. Messages may include appointment confirmations and reminders, replies to your questions, service updates, and, if you opted in to marketing, offers and promotions.

Message frequency varies. You may receive up to [NUMBER] messages per month, plus replies to conversations you start.

Message and data rates may apply. Check with your wireless carrier for details.

To stop receiving messages, reply STOP at any time. You will receive one final message confirming that you have been unsubscribed. To rejoin, reply START.

For help, reply HELP, email [BUSINESS EMAIL], or call [BUSINESS PHONE].

Carriers are not liable for delayed or undelivered messages.

Your privacy. Your mobile number and your consent to receive text messages will not be shared with or sold to third parties for their marketing purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Our full privacy policy is at [PRIVACY POLICY URL].

These texts are sent using High Level Claw, a platform operated by Open Claw Assistance LLC, which processes your messages on our behalf.

☐ I agree to receive text messages from [BUSINESS LEGAL NAME] at the number provided, including [appointment reminders and service updates] [and marketing offers]. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. See our [Messaging Terms] and [Privacy Policy].

Use two separate checkboxes if you collect consent for informational and marketing texts separately. Neither box may be prechecked.

B3. Keyword opt-in disclosure (print or display where the keyword is advertised)

Text [KEYWORD] to [PHONE NUMBER] to receive [offers and updates] from [BUSINESS LEGAL NAME]. Message frequency varies, up to [NUMBER] msgs/month. Msg & data rates may apply. Reply STOP to cancel, HELP for help. Terms: [SMS TERMS URL]. Privacy: [PRIVACY POLICY URL].

"Would it be okay if we text you at this number with appointment reminders and updates [and occasional offers]? Message and data rates may apply, and you can reply STOP at any time to opt out. Can I confirm that is a yes?"

The Contact must answer clearly. The Service records the recording reference, timestamp, and the consent type in the consent ledger when the AI Receptionist obtains verbal consent.

B5. First message and confirmation templates (sent automatically by the Service)

Opt-in confirmation:

C3. Campaign description (submitted verbatim)

[CUSTOMER LEGAL NAME] ([CUSTOMER BRAND NAME]) is a [CUSTOMER INDUSTRY] business serving customers in [CUSTOMER SERVICE AREA]. This campaign sends customer care, account notification, and marketing messages to customers and prospects who have opted in. Customer care messages include replies to questions customers text to the business number and follow-ups to missed calls from customers who called the business. Account notification messages include appointment confirmations, reminders, rescheduling, booking links, quotes, invoices, payment confirmations, service and job status updates, and requests for feedback after service. Marketing messages include seasonal offers, promotions, and new service announcements, sent only to customers who gave prior express written consent to marketing texts. Consent is collected through the business's website forms with an unchecked checkbox and the required disclosures, through keyword opt-in advertised with the required disclosures, and verbally with a recorded confirmation. Every conversation identifies the business, every marketing message includes opt-out instructions, STOP is honored immediately with a single confirmation, and HELP returns contact information. Messages are sent only between 8 a.m. and 9 p.m. in the recipient's local time. Messages are sent through the High Level Claw platform operated by Open Claw Assistance LLC.

C4. Message flow and call to action (submitted verbatim)

Customers opt in in three ways. (1) Website form: on [CUSTOMER WEBSITE], the customer enters their phone number and checks an unchecked box that reads: "I agree to receive text messages from [CUSTOMER LEGAL NAME] at the number provided, including appointment reminders and service updates and marketing offers. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. See our Messaging Terms and Privacy Policy." Both policies are linked next to the checkbox. (2) Keyword: the customer texts [CUSTOMER KEYWORD] to the business number in response to signage or advertising that states the message frequency, that message and data rates may apply, and the STOP and HELP instructions, with links to the terms and privacy policy. (3) Verbal: during a call, the customer is asked whether the business may text them, is told that message and data rates may apply and that they can reply STOP at any time, and the confirmed yes is recorded with a timestamp. Customers who text the business first receive conversational replies for that conversation. After any opt-in the customer receives a confirmation message with the business name, frequency, rates, STOP, and HELP information. Messaging terms: [CUSTOMER SMS TERMS URL]. Privacy policy: [CUSTOMER PRIVACY POLICY URL].

C5. Sample messages (submitted verbatim, five samples)

  1. [CUSTOMER BRAND NAME]: Hi [First name], we saw we missed your call. How can we help? Reply here or call [CUSTOMER PHONE]. Reply STOP to opt out.

  2. [CUSTOMER BRAND NAME]: Your appointment is confirmed for [Day, Date] at [Time] at [Location]. Need to change it? Reschedule here: [LINK]. Reply STOP to opt out.

  3. [CUSTOMER BRAND NAME]: Reminder: your appointment is tomorrow at [Time]. Reply C to confirm or R to reschedule. Reply STOP to opt out.

  4. [CUSTOMER BRAND NAME]: Your invoice #[Number] for $[Amount] is ready. Pay securely here: [LINK]. Questions? Call [CUSTOMER PHONE]. Reply STOP to opt out.

  5. [CUSTOMER BRAND NAME]: Thanks for choosing us, [First name]! This month, [OFFER DETAILS]. Book here: [LINK]. Msg & data rates may apply. Reply STOP to opt out.

C6. What we do not submit

We do not submit campaigns for the prohibited categories in the Acceptable Use Policy, and we do not submit restricted categories without the enhanced vetting and written approval described there. We do not submit a campaign until the Customer has approved the filled program text, entered valid privacy policy and messaging terms URLs that resolve to pages containing the required language, and confirmed the accuracy of the brand information.

Changes

We update this document when carrier, TCR, CTIA, FCC, or state requirements change. Material changes to Part A are announced in the Service or by email. Customers must update their published Part B pages when we publish a new template version; the Service updates Tenant Site pages automatically.
